What is the DMCA?

Before You Begin


Be Truthful. To submit a notice of infringement under the DMCA, you must swear to the facts in your notice under penalty of perjury. Intentionally providing false information is a federal offense (see U.S. Code, Title 18, Section 1621) and could also result in civil liability.

Conduct an Investigation. Millions of users and organizations create content with ClientLab, and filing a DMCA notice against them is a serious legal allegation that could have real consequences. Therefore, we urge you to conduct a thorough investigation and consult with an attorney before submitting a takedown request to ensure that the use of the content is not actually permitted.

Try Contacting the User First. A recommended first step before submitting a takedown notice is to try contacting the user directly.

No Bots Allowed. Every takedown notice you send should be evaluated by a trained professional. If you're outsourcing your efforts to a third party, make sure you're familiar with their practices, and ensure they're not using automated bots to submit bulk notices. These notices are often invalid, and processing them results in needlessly taking down content.

You May Receive a Counter Notice. Any user affected by your takedown notice may file a counter notice. If this happens, we will re-enable their content within 14 days unless you inform us that you've initiated legal action seeking to restrain the user from infringing the content on ClientLab.

ClientLab Is Not the Judge. In the process, ClientLab exercises minimal discretion, limited to determining whether the notices meet the DMCA's minimum requirements. The parties (and their attorneys) must evaluate the merit of their claims, bearing in mind that the notices must be made under penalty of perjury.
